**Terms and Conditions for iPhone Sales**

These Terms and Conditions ("Terms") govern the purchase of iPhones ("Products") from
Sbumkansi Communications PTY LTD ("we," "us," or "our"). By purchasing or placing an
order for our Products, you ("Customer," "you," or "your") agree to be bound by these
Terms. Please read them carefully before making a purchase.
### 1. General Purchase Terms
1.1 **Eligibility**: Customers must be at least 18 years old and have the legal capacity
to enter into a binding agreement.
1.2 **Product Availability**: All Products are subject to availability. We reserve the right
to limit quantities or refuse service at our discretion.
1.3 **Pricing**: Prices are as listed at the time of purchase and exclude additional fees
such as delivery charges, unless otherwise stated. Prices are subject to change without
prior notice, except for confirmed laybuy agreements.
### 2. Laybuy Payment Option
2.1 **Eligibility for Laybuy**:
- The laybuy option is available only for brand-new iPhones that are not on special offer
or discounted.
- To initiate a laybuy, Customers must pay a minimum deposit of 20% of the Product’s
full price at the time of order.
- The remaining balance must be paid in full within three (3) months from the date of the
initial deposit.
2.2 **Changes to Product Selection**:
- Customers may upgrade to a higher-priced brand-new iPhone during the laybuy
period, subject to availability and additional payment for the price difference.
- Downgrading to a lower-priced iPhone is not permitted.
2.3 **Payment Schedule**:
- Payments must be made in accordance with the agreed-upon schedule provided at
the time of order.
- Failure to make timely payments may result in cancellation of the laybuy agreement
and forfeiture of payments made, as outlined in Section 3.
### 3. Cancellation and Refunds
3.1 **Cancellation by Customer**:
- If you choose to cancel your laybuy agreement before full payment, a cancellation fee
of 40% of the amount already paid will be charged.
- Any refund due after the cancellation fee will be processed and paid within seven (7)
business days from the date of cancellation. Same-day refunds are not available.
3.2 **Cancellation by Us**:
- We reserve the right to cancel any order or laybuy agreement due to non-payment,
unavailability of the Product, or any other reason at our discretion. In such cases, any
payments made will be refunded in full within seven (7) business days, without any
cancellation fee.
### 4. Delivery
4.1 **Release of Products**:
- Products will be released to the Customer only after the full purchase price has been
paid, including any applicable fees.
4.2 **Delivery Fees**:
- A delivery fee of R200 will be charged for all deliveries, unless otherwise agreed in
writing.
- Delivery timelines and methods will be communicated at the time of order
completion. We are not responsible for delays caused by third-party couriers.
### 5. Product Condition and Warranty
5.1 **Condition**: All iPhones are sold in the condition described at the time of
purchase (e.g., brand-new, refurbished, or used). Laybuy options are available only for
brand-new iPhones, as per Section 2.1. Customers are responsible for reviewing
Product descriptions before purchase.
5.2 **Warranty**: Products may come with a manufacturer’s warranty, subject to the
terms provided by the manufacturer. We do not offer additional warranties unless
explicitly stated.
### 6. Customer Responsibilities
6.1 **Accuracy of Information**: Customers must provide accurate contact and
payment information. We are not responsible for delays or issues arising from incorrect
information.
6.2 **Compliance with Payment Terms**: Customers are responsible for adhering to
the laybuy payment schedule and ensuring timely payments.
### 7. Limitation of Liability
7.1 We shall not be liable for any indirect, incidental, or consequential damages arising
from the purchase or use of our Products, including but not limited to loss of data or
profits.
7.2 Our liability is limited to the amount paid by the Customer for the Product.
### 8. Governing Law
These Terms are governed by the laws of South Africa. Any disputes arising from these
Terms will be resolved in the courts of law
### 9. Amendments
We reserve the right to update or modify these Terms at any time without prior notice.
The updated Terms will apply to all purchases made after the date of revision.
